US Regional Privacy Notice

This United States Regional Privacy (“US Notice”) is provided by TAKA-WPR USA CORP. (“we” or “us”) and supplements https://taka-adhesives.us’s Privacy Policy (“Privacy Policy”) and is incorporated by reference herein. https://taka-adhesives.us  is operated by TAKA-WPR USA CORP. (“TAKA-WPR” or “we”). The words “user”, “you” and “your” in this US Notice refer to a user of the Site. 

This US Notice provides additional information for residents of California, Colorado, Connecticut, Iowa, Tennessee, Texas, Utah and Virginia, and the rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act, the Colorado Privacy Act, the Connecticut Act Concerning Personal Data Privacy and Online Monitoring, the Iowa Act Relating to Consumer Data Protection, the Tennessee Information Protection Act, Texas Privacy and Security Act, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act, or any other similar state law promulgated in connection with or with similar terms of the forgoing. We call these laws collectively the “US Privacy Laws.”

If you are a Consumer residing in California, Colorado, Connecticut, Iowa, Tennessee, Texas, Utah or Virginia, the following provisions may apply to our processing of information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household subject to the US Privacy Laws.

In the event of a conflict between this US Notice and any of our other TAKA-WPR privacy policies, this US Notice shall control only with respect to users of the Site which reside in California, Colorado, Connecticut Tennessee, Texas, Utah and Virginia, and their Personal Information (as defined herein). We reserve the right to amend this US Notice at our discretion at any time. When we make changes to this US Notice, we will post the updated notice on our website and update the US Notice’s effective date.

INFORMATION WE COLLECT

We collect and use information that identifies, relates to, describes, references and is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or household (“Personal Information”). This includes information that you provide to us directly, information we collect from you automatically, information that we collect when you interact with us such as through your online postings, and information that we may collect from third parties such as service providers, affiliated companies, marketing or data partners, or other third parties with whom you interact. It also includes information that we collect about business partners.  Not all information is collected from everyone who interacts with us.

In particular, we may collect, and may have collected during the 12-month prior to the effective date of this U.S. Notice, the following categories of Personal Information:

  • Identifiers: information that identifies you, including your legal name, email address, unique personal identifiers (such as a device identifier and/or IP address), account name (e.g., username), government-issued ID numbers (e.g., driver’s license) which we may use to verify your identity.
  • Other Records: such as phone number, billing address, credit or debit card information, and any other Personal Information which may overlap with other categories listed here.
  • Demographic Information: such as your age or gender, or, where you have provided such information to us voluntarily, demographic information about your race, ethnicity, sexual orientation, or gender identity, provided in connection with market research or marketing campaigns we conduct. This category includes information that may qualify as protected classifications under state or federal laws.
  • Commercial Information: including purchases, products sold, and/or your interaction with the Site.
  • Internet or Other Network Activity: information including your interactions with our Site and what led you to our Site (including web/mobile traffic related information); device type and/or identifier, operating system and version, browser type and settings and cookie-related data.
  • Sensory Information: data categorized as visual data, such as pictures or videos posted on our Site.
  • Geolocation Data: your general location provided through location-enabled services such as WiFi and GPS or precise location information, with your consent, when enabled through one of our mobile applications or from your mobile device settings.
  • Inferences: inferences based on Personal Information about you, including your interests, preferences, and favorites; inferred information about your demographic category used to create marketing segments or profiles.

HOW WE COLLECT YOUR DATA

We collect the categories of personal information described in this US Notice from the sources described in TAKA-WPR’s Privacy Policy (Tyes of Information we Collect From Users & How We Collect It), which includes collecting information directly from you, your devices, and our partners. The sources of this data include you, advertising networks, service providers (including internet service providers), social networks, marketing and business partners, and our vendors and suppliers.

HOW WE USE PERSONAL INFORMATION

We do not sell your Personal Information in exchange for monetary compensation. We may share your Personal Information by allowing certain third parties (such as online advertising services) to collect Personal Information through automated technologies on our Site for targeted (cross-context behavioral) advertising purposes. This kind of sharing may be considered a “sale” under applicable state laws, and you have a right to opt out of it, as more fully set forth herein.

We may sell or share for cross-contextual or interest-based advertising purposes (and may have sold or shared during the 12-month period prior to this US Notice) the following categories of Personal Information about you to online advertising services or networks:

  • Identifiers;
  • Commercial Information; and/or
  • Internet or Network Activity.

RIGHT TO KNOW
You have the right, upon submission of a verifiable consumer request, that we disclose the categories and specific pieces of Personal Information we collect, the purposes for which we use it, and the categories of third parties with whom we share it. You have the right to confirm whether we use or disclose your Personal Information and to access the specific data we have collected about you.

Upon verifying your identity, you may request a portable copy of your Personal Information, up to twice per calendar year.  Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of: 
    • Personal Information we collected about you; and
    • sources from which we collected your Personal Information.
  • The business or commercial purpose for collecting your Personal Information and, if applicable, selling or sharing your Personal Information.
  • If applicable, the categories of persons, including third parties, to whom we disclosed your Personal Information, including separate disclosures identifying the categories of your Personal Information that we:
    • disclosed for a business purpose to each category of persons; and
    • sold or shared to each category of third parties.

CORRECTION RIGHTS
You may request corrections to inaccurate or incomplete Personal Information we maintain about you. We may require documentation to verify the requested correction. In some cases, certain state laws or other legal obligations may prevent us from fully granting your request; if so, we will explain why.

DELETION RIGHTS
You may request that we delete Personal Information we collected from you, subject to statutory exceptions. After confirming your verifiable request, we will delete your data and instruct our service providers to do the same, unless an exception applies. If we cannot comply with your deletion request, we will explain the reason.

RIGHT TO OPT-OUT
You have the right to direct us not to:

  • Process your Personal Information for targeted advertising;
  • Sell your Personal Information; and
  • Engage in profiling solely for automated decisions with legal or similarly significant effects (e.g., affecting financial services, employment, healthcare, or access to essential goods/services).

RIGHT TO NON-DISCRIMINATION

You have the right not to be discriminated against or retaliated against for exercising any of your privacy rights under this US Notice.

RIGHT TO APPEAL
If we cannot fully comply with your request, we will provide an explanation as to why. You may appeal by submitting a request and we will inform you of any action taken in response to the request, explaining the reasoning behind the decision within 45 days. If your appeal is denied, you may contact your state Attorney General to submit a complaint. Contact details are available on your state’s Attorney General website.

HOW TO EXERCISE YOUR RIGHTS; SUBMITTING REQUESTS
To exercise your rights to access, correct, or delete your Personal Information, contact us at [email protected]. We may request additional information to verify your identity. We will only use data provided in your request for verification and compliance purposes. If insufficient information is provided, we may only process your request to the extent we can identify you in our systems.  Please describe your request in sufficient detail so we can properly understand, evaluate, and respond to it.

Only you, or someone legally authorized to act on your behalf, may make a request to know, delete or correct data related to your Personal Information.  We cannot respond to your request to know, delete or correct if we cannot verify your identity or authority to make the request and confirm the personal information related to you. We may request specific information from you or your authorized representative to confirm your or their identity before we can process your right to know, delete, or correct your personal information, e.g., user name, email address, parental or guardian verification requirements.

AUTHENTICATION
To protect your data and comply with privacy laws, we verify your identity before acting on requests. Authorized agents may submit requests on your behalf, provided we receive proof of authorization. We use reasonable measures to detect fraud and prevent unauthorized access. Requests do not require you to create an account, and no fee is required for authentication.

RESPONSE TIMING AND FORMAT

Responding to your Requests to Know, Delete or Correct

We will confirm receipt of your request within ten business days. If you do not receive confirmation within the ten-day timeframe, please email [email protected].

We endeavor to substantively respond to a verifiable request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response to your verified email address or postal address. Our substantive response will tell you whether or not we have complied with your request. If we cannot comply with your request in whole or in part, we will explain the reason, subject to any legal or regulatory restrictions. Applicable law may allow or require us to refuse to provide you with access to some or all of your Personal Information, or we may have destroyed, deleted, or made your Personal Information anonymous in compliance with our record retention policies and obligations.

Any disclosures we provide will cover information for the 12-month period preceding the request’s receipt date.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, subject to any redactions.

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Response Timing to your Request to Limit or Opt-Out

In response to your request to limit or opt-out, we will process your request, as soon as feasibly possible, but no later than 15 business days from the date we receive the request. We will only use Personal Information provided from your request to comply with the request. We may deny opt-out requests if we have a good-faith, reasonable, and documented belief that the request is fraudulent and will clearly explain our denial decision to the requestor.

Once you make a request to limit or opt-out, we will wait at least 12 months before asking you to reauthorize the use or disclosure of your Personal Information for sales or sharing. However, you may change your mind and opt back in at any time by emailing us at [email protected].
