The Site is operated by TAKA-WPR USA CORP. (“TAKA-WPR”, or “we”). The words “user”, “you” and “your” in this Privacy Policy refer to a user of the Site. Throughout, “Personal Information” refers to any information or data that is linked or reasonably linkable to an identified or identifiable individual. Personal Information does not include de-identified data or publicly available information.

TYPES OF INFORMATION WE COLLECT FROM USERS & HOW WE COLLECT IT

When you use the Site, the types of information we may collect include:

  • Personally Identifiable Information. Information provided by you by registering on the Site, making a purchase on the Site, subscribing to our newsletter, contacting us through the Site or via email, including your name, address, shipping address, credit/debit card information, email address, and phone number.
  • Automatically Collected Information. Information not associated with specific users, such as device type, location information, IP address, webpage traffic, and access time is automatically collected in order to ensure the Site’s functionality. Automatic means of data collection include cookies and web beacons.   • Third Party Sourced Information. We do not control these third parties’ tracking technologies or how they may be used.   • Business Partners or Service Providers Sourced Information.  We may receive Personal Information about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email platform providers, content delivery services, payment processors, promotions services, gift card program providers, analytics, security and anti-fraud services. We also may receive Personal Information from business partners that we engage to share consumer information with us, including your personal preferences and demographic information such as age, gender, and income level so that we can better provide you with a personalized experience.
  • Social Media Features Sourced Information.  When accessing the Site through a third party social media site and/or application, we may access some of your information from your social media account, such as name, email address, profile picture, location, friend list, posts and/or likes. Please note that some aggregate information that does not personally identify you, such as content viewed on the social media site/application, may also be collected by us if you access the Site through a third party social media site.  Some of the Site’s services are integrated with social sharing features, e.g., liking or sharing a service on a social media platform.  Depending on your settings on your social media accounts, these activities may show up on your profile and be visible to your friends/followers and/or the public.  Please note that this Privacy Policy does not apply to third party social media sites, and you should always refer to the privacy policies of the relevant social media sites for information concerning their collection and processing of information.
  • Cookies.  Cookies are small text files that are stored on your device when you visit a website. They are widely used to make websites work more efficiently, as well as to provide information to the website owners. The information in the cookie lets TAKA-WPR trace “clickstream” activity (i.e., the paths taken by visitors to the Site as they move from page to page) to enable us to better serve our customers by revealing which portions of the Site  are the most popular. Cookies also help us improve your shopping experience by, among other things, keeping track of your preferences, recognizing you if you have a shopping account, and tracking your shopping basket as you shop. We may link the anonymous visitor ID from your cookie to a user ID in our database to help us analyze web traffic and statistics. This takes place when you visit the Site or when we run temporary marketing campaigns. HOW WE USE YOUR INFORMATION

Your information is processed using primarily electronic means and is used, without limitation, for the following services:

As stated above, while we make commercially reasonable efforts to ensure your information is processed and stored in a secure manner, we cannot guarantee the security of data transferred over the Internet and you assume the risk of any such transfer. 

WHERE AND FOR HOW LONG WE STORE YOUR INFORMATION

Your information will be collected and stored in the United States and the European Economic Area. We keep the categories of Personal Information described in this Privacy Policy or as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Site, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain Personal Information. At the end of the retention period, Personal Information will be deleted, destroyed, or deidentified.

SHARING YOUR INFORMATION

We will not sell or otherwise disclose your information, except as described in this section and other relevant sections of this Privacy Policy.

  • We may share your information with companies affiliated with TAKA-WPR, including licensees and joint venture partners, who may be located outside the United States. These parties may only use your information in compliance with this Privacy Policy. 
  • We may retain third party service providers in order to process your data in connection with the services provided on the Site (e.g., order fulfillment, IT support, customer service or marketing communications). Third parties who perform these operations are only permitted to use the information provided to them to perform their function and for no other purpose.   • We may disclose a user’s information when required to do so to comply with applicable law or legal process or to respond to a request from law enforcement authorities. We may also provide your information where necessary for the defense of legal claims or for billing and collection purposes.

The Site contains links to third party websites, which we do not operate, control, monitor, endorse or guarantee. This Privacy Policy does not apply to the collection and use of information by such third party websites. UNDER NO CIRCUMSTANCES SHALL TAKA-WPR BE LIABLE FOR DAMAGES ARISING FROM ANY TRANSACTION BETWEEN YOU AND ANY THIRD PARTY WEBSITE OR FOR ANY INFORMATION APPEARING ON THIRD PARTY WEBSITES.

INTERNATIONAL RESIDENT INFORMATION

TAKA-WPR is based in the United States, and your data is processed by us in the United States and the European Economic Area. The third parties to whom we disclose your Personal Information (as described in TYPES OF INFORMATION WE COLLECT FROM USERS & HOW WE COLLECT IT) may be located in jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. Where this is the case, we will take steps to ensure that your Personal Information receives an adequate level of protection in the jurisdictions in which we process it.

For Residents of the European Economic Area (EEA) and the United Kingdom

Notwithstanding the foregoing, TAKA-WPR is committed to complying with applicable international data protection regulations, including the General Data Protection Regulation (GDPR) and will transfer Personal information within our organization and with third party services providers in accordance with appropriate or suitable safeguards recognized under the GDPR.

CHANGING, UPDATING OR REMOVING YOUR INFORMATION

OPTING OUT OF OUR NEWSLETTER AND EMAIL COMMUNICATIONS

You may unsubscribe from any marketing communications by clicking on the “Unsubscribe” button included in all of our marketing communications or by contacting us at [email protected]. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

DO NOT TRACK SIGNALS

Our Site does not recognize Do Not Track signals. Some third parties may collect aggregate information about the users’ online activities over time and across websites when they use the Site. While this information does not include Personal Information, certain processing activities that combine aggregate information with other information in possession of such third parties could result in the identification of users.

CALIFORNIA SHINE THE LIGHT LAW

If you are a California resident and have an established business relationship with us, you may request that we not disclose your Personal Information to third parties for the third parties’ own direct marketing purposes (as defined in California Civil Code section 1798.83) during the preceding calendar year. CHILDREN’S RIGHTS

While we do not sell products or services for purchase by children. If you are under 18 years old, you may use the Site only under the supervision of a parent or guardian.  In accordance with the Federal Children’s Online Privacy Protection Act of 1998 (COPPA), we do not knowingly collect, solicit or use Personal Information of children under the age of 13 provided without parental consent. Should we become aware that a user under the age of 13 has registered without verifiable parental consent, any such information will be deleted.
